These Terms of Service (“Terms”) govern your use of the Revampd Inc. (“Revampd Inc.,” “we,” “us,” or “our”) platform, software, websites, and related services (collectively, the “Services”).
These Terms form a binding legal agreement between you or the entity you represent (“Customer,” “you,” or “your”). If you accept these Terms on behalf of an entity, you confirm you have the authority to bind that entity to these Terms.
Acceptance of Terms
By creating an account, accessing, or using the Services in any way, you:
Acknowledge that you have read and understand these Terms, including the TCPA & Calling Compliance Addendum (incorporated by reference).
Agree to comply with all applicable federal, state, and local laws, including those governing telemarketing, texting, call recording, and consumer privacy.
Accept that you are solely responsible for legal compliance in your use of the Services.
Agree that Revampd Inc. is not a law firm, compliance service, or legal advisor.
If you do not agree to these Terms, you must not create an account or use the Services.
1. Services Access
During your paid subscription term, Revampd Inc. grants you a limited, non-exclusive, non-transferable license to access and use the Services solely for lawful business purposes in accordance with these Terms. You must create an account to use the Services and provide accurate and complete information.
2. Your Responsibilities
You are solely responsible for:
All data, content, campaigns, scripts, call recordings, messages, and other materials transmitted or generated through the Services (“Customer Data”).
Ensuring that every call, text, voicemail, or communication complies with all applicable laws, including:
Telephone Consumer Protection Act (TCPA)
Telemarketing Sales Rule (TSR)
Federal Trade Commission (FTC) Do Not Call rules
State-level telemarketing & DNC laws
Call recording and wiretap laws (one-party/two-party consent rules)
CAN-SPAM Act (for email campaigns)
Obtaining, documenting, and maintaining valid prior express consent where required.
Providing all legally required disclosures, including opt-out instructions.
Honoring all Do-Not-Call and opt-out requests promptly.
3. Telemarketing & Calling Compliance
The Services may be used for outbound calls, texts, and campaigns. You expressly agree:
Consent Requirement – You will not initiate any call, text, or voicemail without first obtaining the required level of prior express consent from the recipient. For prerecorded/artificial voice messages to mobile numbers or residential lines, prior express written consent may be required under TCPA.
Do Not Call (DNC) Compliance – You will scrub all numbers against the National and applicable state Do Not Call registries, unless an exemption applies, and maintain proof of scrubbing.
Identification & Disclosures – All calls must begin with your legal business name, a working callback number, and any other disclosures required by law.
Call Recording Laws – You are solely responsible for complying with one-party or two-party consent requirements before recording any call.
Prohibited Numbers – You will not contact emergency numbers, healthcare facilities, numbers assigned to elderly homes, or numbers where the recipient is charged for the call without required consent.
Content Restrictions – You will not use the Services to send fraudulent, misleading, harassing, or unlawful communications.
Recordkeeping – You will maintain detailed records of consent, call attempts, and opt-out handling for at least 4 years and provide certified copies upon our request.
No Legal Advice – You acknowledge that Revampd Inc. does not provide legal compliance advice. Any templates, tools, or examples provided are for informational purposes only.
4. Prohibited Activities
You may not:
Use the Services to violate any applicable law.
Send spam, abusive content, or unauthorized messages.
Attempt to bypass security features.
Use the Services to build a competing product.
Share login credentials outside your organization.
Manipulate caller ID information unlawfully (“spoofing”).
5. Suspension & Termination
Revampd Inc. may suspend or terminate your account immediately, without refund, if we determine (in our sole discretion) that you:
Violated any telemarketing, texting, call recording, or privacy laws;
Used the Services in a manner that may expose Revampd Inc. to legal risk;
Failed to maintain adequate consent or compliance documentation.
6. Customer Data
You retain ownership of your Customer Data, but you grant Revampd Inc. a limited license to process it solely for operating and improving the Services. You are solely responsible for ensuring your Customer Data does not violate any law or infringe the rights of others.
7. Indemnification
You agree to defend, indemnify, and hold harmless Revampd Inc., its officers, employees, and agents from any claims, damages, fines, penalties, legal fees, or liabilities arising from or related to:
Your violation of telemarketing, texting, call recording, or privacy laws;
Any campaign, call, text, or voicemail initiated through your account;
Your failure to obtain required consent or honor opt-out requests.
8. Limitation of Liability
To the fullest extent permitted by law:
Revampd Inc. is not liable for any indirect, incidental, special, or consequential damages, including lost profits, lost revenue, loss of data, or business interruption.
Our total liability to you will not exceed the amount paid by you to Revampd Inc. in the 3 months before the claim arose.
You are solely responsible for your use of the Services and any resulting communications.
9. No Warranty
The Services are provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Governing Law & Venue
This Agreement is governed by the laws of the State of Wyoming without regard to its conflicts of laws principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of such courts.
11. Changes to Terms
We may update these Terms at any time by posting the revised version on our website. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
